Reckless negligence and a dangerous condition of public property have landed a California corporation and local government entities in legal hot water. On November 1, 2024, Reimundo Tun Puc filed a complaint in the Superior Court of California, County of San Francisco, against the City of San Francisco, County of San Francisco, VIP Powerline Corp., and unnamed defendants. The lawsuit accuses these parties of negligence and creating hazardous conditions that led to severe injuries.
The case centers around an incident on September 12, 2023, when Reimundo Tun Puc was riding his electric scooter near Avenue I and 11th Street in San Francisco. According to the complaint, the defendants were involved in a powerline project at this location. During their operations, they allegedly allowed a cable to obstruct the path used by pedestrians and vehicles. As Mr. Tun Puc approached on his scooter, he was struck by this cable, resulting in significant injuries. "Defendants' acts or omissions... affirmatively contributed to and caused the incident," states the complaint.
Mr. Tun Puc claims that all defendants had a duty to ensure safety at the project site but failed to do so. The City and County of San Francisco are accused under various sections of the Government Code for failing to protect against known hazards. VIP Powerline Corp., along with other unnamed defendants referred to as Does 1 through 50, is similarly charged with negligence for not maintaining safe conditions during their work.
The plaintiff seeks compensation for general damages exceeding the court's minimum jurisdictional limits due to ongoing pain and suffering from his injuries. He also requests special damages for medical expenses incurred from surgeries and treatments related to his injuries. Additionally, Mr. Tun Puc is seeking lost earnings due to an inability to work following the accident.
