Cyclist Sues Motorist Over Intersection Collision: Allegations Against Phillip Hanna

A California resident has filed a lawsuit following a harrowing bicycle accident that left her with significant injuries and damages. Marilyn Bazinski, the plaintiff, lodged her complaint in the Superior Court of the State of California for the County of San Francisco on November 5, 2024, against Phillip Hanna and unnamed defendants referred to as Does 1-10.

The incident in question occurred on July 21, 2024, when Bazinski was cycling eastbound on Market Street in San Francisco. According to the complaint, she was struck by a vehicle while crossing an intersection with Van Ness Avenue. The vehicle involved was a 2010 Ford Fusion driven by Phillip Hanna, who allegedly made an illegal right turn against a red light, directly colliding with Bazinski and causing her to fall onto the road. As per the court documents, this accident resulted in physical injuries to Bazinski that necessitated medical treatment and incurred expenses which are expected to continue into the future.

Bazinski's legal action accuses Hanna of negligence and negligence per se. She claims that Hanna breached his duty to operate his vehicle safely by violating California Vehicle Code § 21800(a), which mandates yielding at intersections. This breach is cited as a substantial factor leading to her injuries. The plaintiff argues that Hanna's failure to adhere to traffic laws directly caused her physical harm and subsequent financial losses due to medical bills and lost earnings.

In addition to seeking compensation for economic damages such as medical expenses and loss of earnings, Bazinski is also pursuing noneconomic damages for pain and suffering. Her complaint highlights non-economic impacts like mental anguish and loss of enjoyment of life due to the accident. Furthermore, she requests prejudgment interest under Civil Code §§ 3287, 3288, and 3294 alongside coverage for legal costs associated with the suit.
