A San Francisco resident has filed a lawsuit against the city and county, alleging negligence over hazardous sidewalk conditions that led to severe injuries. On December 2, 2024, Jenelle Shawn Delugg lodged a complaint in the Superior Court of California for the County of San Francisco against the City and County of San Francisco.
According to the court documents, Delugg's lawsuit arises from an incident on January 20, 2024, when she tripped over uneven sidewalk slabs caused by tree roots at or around 3548 20th Street in San Francisco. The complaint details how these lifted sections created a "dangerous condition" posing an unreasonable risk to pedestrians. Delugg claims that despite being aware of this hazard due to their responsibility for maintaining the property, both the city and county failed to address it adequately. The complaint further alleges that other similar incidents have occurred at this location, indicating a pattern of neglect.
Delugg's legal action accuses the defendants of several counts: dangerous condition of public property, premise liability, and negligence. She argues that they had a duty to ensure safe conditions on their property and failed in this obligation by not inspecting or repairing the defective sidewalk or providing adequate warnings about its dangers. "The conduct of these defendants was a direct and substantial factor in causing her harm," states the complaint. Delugg asserts that her injuries have resulted in ongoing physical, mental, and emotional pain and suffering, necessitating medical treatment and leading to loss of earnings.
The plaintiff seeks general damages exceeding $35,000 as well as special damages according to proof at trial. Additionally, she requests interest on any awarded amounts, coverage for legal costs incurred during the suit, and any further relief deemed appropriate by the court.
