A class-action lawsuit has been filed against a California-based healthcare corporation, accusing it of numerous labor law violations. The complaint was lodged by Asa Meui, Vitesh Chand, Rose Chikwendu, Maica Valencia, and Yolanda Kruizenga on December 13, 2024, in the Superior Court of California, County of Santa Clara. The defendants include Lorian Health and its subsidiaries.
The plaintiffs allege that Lorian Health systematically violated several labor laws by failing to pay minimum wages and overtime, denying meal and rest breaks, not reimbursing business expenses, and providing inaccurate wage statements. The complaint states that these practices have been ongoing for at least four years prior to the filing date. According to the plaintiffs' legal representation from Infinity Law Group LLP, the company misclassified employees as exempt from overtime regulations and failed to provide legally mandated breaks. "Defendants failed to compensate Class Members for all hours worked," the complaint reads.
In addition to unpaid wages and overtime compensation, the plaintiffs seek liquidated damages for failure to pay minimum wages as per Labor Code § 1194.2. They also demand penalties for not providing accurate wage statements under Labor Code § 226 and seek reimbursement for necessary business expenses like cell phone bills and vehicle costs under Labor Code § 2802. Furthermore, they claim that Lorian Health engaged in unfair business practices in violation of Business & Professions Code §§ 17200 et seq., which includes failing to provide written commission plans as required by Labor Code § 2751.
The plaintiffs are seeking a variety of remedies from the court including unpaid wages, statutory penalties, restitution for unfair business practices, declaratory relief affirming their rights under California labor laws, injunctive relief preventing further violations by Lorian Health, attorneys' fees and costs associated with bringing this action forward. They also demand a jury trial.
