In a gripping legal battle that underscores the perils of public infrastructure, a San Francisco resident has taken a stand against local authorities, claiming negligence and seeking justice for injuries sustained at a major transit hub. Shannon Feser filed a complaint on December 18, 2024, in the Superior Court of California, County of San Francisco, against the City and County of San Francisco, the San Francisco County Transportation Authority, and the Transbay Joint Powers Authority.

The case revolves around an incident that occurred on November 21, 2023, when Shannon Feser visited the Salesforce Transit Center in San Francisco. According to the complaint, Feser was directed by a transit center employee to use an escalator that was out of operation. As she attempted to navigate this non-functional escalator alongside an adjacent moving one, she became disoriented and fell, resulting in severe injuries. The plaintiff alleges that these injuries include damage to her nose, face, head, brain, neck, and other areas yet to be fully diagnosed. The claim asserts that the defendants were aware or should have been aware of this hazardous condition but failed to take appropriate action to prevent harm.

Feser's legal team argues that the defendants breached their statutory duty under Government Code § 835 by failing to maintain safe conditions at the Salesforce Transit Center. They contend that this breach directly led to Feser's physical injuries and subsequent economic losses due to medical expenses and lost wages. "The dangerous condition posed a foreseeable risk of injury," states the complaint, emphasizing how defendants neglected their responsibility to mitigate such risks or adequately warn users like Feser.

The lawsuit seeks various forms of relief from the court. These include general damages for pain and suffering as well as special damages covering past and future medical costs and lost income. Additionally, Feser requests pre-judgment interest on these amounts and reimbursement for legal costs incurred during litigation.
