The case revolves around an incident that occurred on January 21, 2023, when Rodriguez was visiting Roccapulco's premises located at 3140 Mission St., San Francisco. According to the complaint, while attempting to speak with a manager about her companions being escorted out of the venue, Rodriguez became an unintended victim of violence. The lawsuit details how a security guard known only as John Doe allegedly assaulted Rodriguez during an altercation between other patrons and security staff. This alleged attack resulted in physical injuries and psychological trauma for Rodriguez.
Rodriguez's legal representation argues that John Doe's actions were not only intentional but also malicious and oppressive. They claim his conduct was intended to cause harm and was executed with willful disregard for Rodriguez's rights and safety. Furthermore, the complaint asserts that Doe's aggressive behavior violated California Civil Code § 3294, which could subject him to punitive damages.
In addition to assault and battery claims against John Doe, the lawsuit accuses Roccapulco and its affiliates of negligence. It alleges these entities failed in their duty to protect patrons from unreasonable harm by employing an incompetent security guard who posed a risk to others.
