Despite multiple attempts to have these issues resolved through authorized repair facilities, the problems persisted. The complaint alleges that Mercedes-Benz USA violated the Song-Beverly Consumer Warranty Act by not adhering to express and implied warranties. "Defendants violated the Song-Beverly Consumer Warranty Act by failing to conform the Vehicle to the express written warranties within a reasonable number of repair attempts," states the lawsuit.
In addition to breach of warranty claims under the Song-Beverly Act, Eagle Eye Machine also accuses Mercedes-Benz USA of violating California's Business and Professions Code § 17200. This section addresses unlawful and unfair business practices. The complaint details how Mercedes-Benz allegedly engaged in deceptive conduct by knowingly selling vehicles with defective components and failing to properly address these issues despite being aware of them. The lawsuit highlights that "Defendant intentionally placed the Subject Vehicle with defective components into the stream of commerce," suggesting a deliberate attempt to mislead consumers.
Eagle Eye Machine is seeking various forms of relief from the court. They request actual damages amounting to $130,751.04 as well as consequential and incidental damages related to their purchase. Furthermore, they are asking for restitution equivalent to all payments made towards acquiring the vehicle and civil penalties under the Song-Beverly Act amounting to twice their actual damages. In addition to financial compensation, Eagle Eye Machine seeks injunctive relief requiring Mercedes-Benz USA to comply with its legal obligations during this litigation process.
