Truck Insurance Exchange has filed a lawsuit against Westco Roofing Company, Inc., alleging negligence that resulted in significant property damage. The complaint was lodged by Truck Insurance Exchange on January 3, 2025, in the Superior Court of California, County of San Francisco, targeting Westco Roofing Company as the defendant.

The case stems from an incident on April 18, 2022, when a fire broke out at a property located at 400 Oyster Point Boulevard, Suite 519, South San Francisco. This property was owned or leased by SKH Inc., doing business as Fuji Japanese Restaurant. According to the complaint, Truck Insurance Exchange had insured this property and subsequently paid out $648,472.04 for damages caused by the fire. The plaintiff alleges that Westco Roofing Company and unnamed defendants (Does 1 through 50) were negligent in their maintenance and oversight of the premises, leading to the fire that damaged both real and personal property.

Truck Insurance Exchange claims that due to their payment for damages under the insurance policy, they have been subrogated to pursue claims against those responsible for the loss. They argue that Westco Roofing Company was acting within its capacity as agents or employees when it failed to properly manage and secure the property, resulting in negligence that led to substantial losses.

In seeking redress from the court, Truck Insurance Exchange is demanding compensation totaling $648,472.04 along with prejudgment interest dating back to February 20, 2023. Additionally, they are asking for reimbursement of legal costs incurred during this suit and any other relief deemed appropriate by the court.
