On January 7, 2025, Brian Gryder filed a complaint in the Superior Court of California, County of Santa Clara, against Morris + D’Angelo CPAs and several individuals associated with the firm.
The case stems from Gryder's employment as a Certified Public Accountant with Morris + D’Angelo CPAs, where he alleges numerous breaches of California Labor Code. Gryder claims that despite an agreement to pay him $117,239 in unpaid wages by January 1, 2022, the defendants only paid $39,358.81. He also accuses them of failing to reimburse business expenses incurred during his employment and not providing necessary personnel records or wage statements as required by law. "Defendants failed to reimburse Plaintiff for any of the necessary expenses that he incurred," Gryder states in his complaint.
Gryder further alleges that he was furloughed without pay on multiple occasions and eventually laid off without receiving his final wages. The complaint details how Gryder requested access to his personnel files and payroll records on July 6, 2022, but the defendants have yet to comply. The plaintiff is seeking damages for breach of contract along with penalties for violations under various sections of the California Labor Code.
The lawsuit demands several forms of relief: compensation for unpaid wages and reimbursement for business expenses, penalties for non-compliance with labor codes concerning wage statements and personnel records, and attorney fees. Gryder emphasizes that these failures were willful acts by the defendants.
