On January 27, 2025, Ryan Lynch lodged the complaint in the Superior Court of California, County of Santa Clara, targeting D & M Traffic Services, Inc. The case brings to light serious allegations concerning wage and hour laws, potentially impacting a wide swath of current and former employees.
Ryan Lynch, represented by Wilshire Law Firm attorneys John G. Yslas and Desiree Ruiz Alfaro, accuses D & M Traffic Services of failing to adhere to multiple provisions of the California Labor Code. The lawsuit outlines eight causes of action including failure to pay minimum and overtime wages, failure to provide meal and rest periods, failure to timely pay final wages upon termination, inaccurate wage statements, and failure to indemnify employees for work-related expenses. Additionally, it alleges unfair business practices under the California Business & Professions Code.
Lynch claims that during his employment from September 2024 to December 2024 as an hourly-paid non-exempt employee in Santa Clara County, he was not compensated for all hours worked nor provided with required breaks. "Defendants have made it impossible or impracticable to take these uninterrupted meal periods," the complaint states. Furthermore, Lynch asserts that upon termination of employment, he did not receive all due wages within the legally specified timeframe.
The lawsuit seeks class certification for all similarly situated individuals employed by D & M Traffic Services in California over the past four years. It aims for restitution of unpaid wages along with penalties and damages as prescribed by law. The plaintiffs demand injunctive relief against ongoing violations and request reasonable attorney fees and costs associated with the suit.
