Antonio Acosta, a former employee, has filed a class action lawsuit against Radiate Hospitality LLC, alleging multiple violations of California labor laws. The complaint was lodged on February 4, 2025, in the Superior Court of California for the County of Santa Clara. Acosta accuses Radiate Hospitality LLC of failing to pay wages correctly and other labor code violations.
According to the complaint filed by Antonio Acosta, he represents himself and others similarly situated in a class action against Radiate Hospitality LLC. The lawsuit outlines numerous grievances including failure to pay all wages earned at correct rates, failure to provide rest and meal breaks, and failure to indemnify employees for necessary work-related expenses. The case also highlights issues such as inaccurate wage statements and untimely payment of wages upon termination. Acosta claims that these actions are in violation of several sections of the California Labor Code including sections 510, 1194, 1197, 1198 for unpaid wages; sections 226.7 and 512 for rest and meal break violations; section 2802 for failure to indemnify; and section 226 for inaccurate wage statements.
The plaintiff argues that Radiate Hospitality's practices have led to systematic underpayment and unfair treatment of its employees. For instance, Acosta alleges that the company had a policy that resulted in "time shaving," which effectively reduced the number of hours recorded as worked by employees. This practice allegedly led to unpaid minimum wages and overtime compensation. Furthermore, Acosta claims that employees were required to provide their own tools without proper reimbursement despite not earning twice the minimum wage—a direct violation of California law.
Acosta is seeking several forms of relief from the court including unpaid wages with interest, liquidated damages, restitution, statutory penalties, attorney’s fees, costs associated with the suit, civil penalties under the Private Attorneys General Act (PAGA), and any other relief deemed appropriate by the court. The lawsuit also demands declaratory relief acknowledging these violations along with an order certifying this case as a class action.
