Plaintiff accuses restaurant operator of deceptive pricing practices

A San Francisco restaurant is under fire for allegedly deceiving its customers with hidden fees. On February 18, 2025, Alexander Xue filed a complaint in the Superior Court of California, County of San Francisco, against P AND F RISTO, INC., accusing the company of violating multiple consumer protection laws by secretly adding a surcharge to customer bills.

According to the complaint, Xue visited "II Casaro Pizzeria & Mozzarella Bar," owned by P AND F RISTO, INC., on October 7, 2024. Before dining at the restaurant located at 348 Columbus Ave in San Francisco, Xue reviewed the menu online and found the prices agreeable. However, after his meal, he discovered an unexpected "Casaro Surcharge" of $4.56 added to his bill without prior notice or consent. This surcharge increased the advertised price of items like Carbonara pasta and Margherita pizza beyond what was initially presented.

Xue argues that this practice constitutes a violation of California's Business and Professions Code §§ 17200 et seq., which prohibits unlawful business acts or practices. He claims that P AND F RISTO engaged in unfair competition by failing to disclose mandatory surcharges and misleading customers about actual prices. The complaint also alleges false advertising under Business and Professions Code §§ 17500 et seq., as well as violations of the Consumer Legal Remedies Act (CLRA), which forbids deceptive business practices.

The plaintiff seeks several forms of relief from the court: an injunction preventing further illegal fee charges by the defendant; refunds for all customers who paid undisclosed fees; reimbursement for legal costs; and any additional relief deemed appropriate by the court. Xue emphasizes that these actions not only mislead consumers but also harm competitors who comply with pricing transparency laws.

Representing himself pro se, Alexander Xue is determined to hold P AND F RISTO accountable for their alleged deceptive practices. The case is presided over by Judge Ana with Case ID CGC-25-622475.
