Gemelly Buenrostro has taken legal action against a popular fast-casual Greek restaurant chain, alleging significant labor violations. The lawsuit, filed on April 11, 2025, in the Superior Court of California for the County of Santa Clara, targets NTG, LLC., also known as Nick The Greek. Buenrostro claims that the company has consistently failed to comply with California labor laws, impacting her and other non-exempt employees.
According to the complaint, Buenrostro accuses NTG, LLC. of multiple infractions including failure to pay minimum and overtime wages, meal and rest period violations, wage statement inaccuracies, and not reimbursing necessary business expenses. These allegations are based on California Labor Code violations such as §§ 204, 210, 226(a), among others. Buenrostro contends that these practices are part of a broader pattern of unfair competition under California Business and Professions Code § 17200 et seq. She states that despite working shifts often exceeding eight hours a day or forty hours a week since May 2023 as a cashier in San Jose, she was not compensated fairly for her time.
The lawsuit further details how NTG's policies have allegedly deprived employees of compliant meal and rest periods. Buenrostro claims that due to operational demands and company policies, employees were unable to take uninterrupted meal breaks or receive proper compensation for missed breaks. Additionally, she asserts that NTG did not provide accurate wage statements or reimburse employees for necessary work-related expenses like personal cell phone use.
In seeking justice through this class action suit, Buenrostro aims to recover unpaid wages and penalties for herself and similarly affected employees. She requests compensatory damages for unpaid wages at both regular and overtime rates along with penalties for inaccurate wage statements. Furthermore, she seeks restitution under the unfair competition law to address the alleged financial harm caused by NTG's practices.
