Former Kaiser employee suing MetLife over disability benefits

SAN FRANCISCO — An Oakland man is suing a national insurance company for allegedly violating the terms of his plan by failing to pay his long-term disability benefits.

Robert Bosley filed a lawsuit on Jan. 10 in the Northern District Court of California against Metropolitan Life Insurance Company. According to court documents, Bosley, who is a former nurse at Kaiser Permanente, received a health and welfare plan through Kaiser Foundation Health Plan Inc. The plan offered disability benefits to employees of Kaiser Permanente through an insurance policy issued by MetLife. Between Feb. 17, 2014 and the present, Bosley allegedly complied with all terms and conditions of the plan, and was considered “totally disabled” under the terms of the plan, according to the suit.

Bosley filed a claim for disability benefits under the plan, but MetLife denied Bosley’s claim allegedly due to the information he submitted not meeting the definition of disability under terms of the plan. MetLife also denied Bosley’s appeal.

Bosley is asking the court to declare that MetLife violated the terms of the plan. He wants the insurance company to pay all long-term disability benefits due to him and all future benefit payments, along with attorney and court fees. Scott Kalkin of Roboostoff and Kalkin are representing Bosley.
