In a dramatic legal filing, a former employee has accused his previous employer of a litany of workplace violations, including whistleblower retaliation and wrongful termination. Ryan Roubal filed the complaint on March 24, 2025, in the Superior Court of California, County of Santa Clara, against Everflow Technologies Inc., Curt Frieden, and other unnamed defendants. The lawsuit alleges severe misconduct by the defendants that resulted in economic and emotional damages to Roubal.
Ryan Roubal claims that during his tenure at Everflow Technologies Inc., a marketing technology company based in California, he was subjected to sexual harassment by Curt Frieden, a senior executive at the company. The complaint details instances where Frieden allegedly harassed Roubal with derogatory nicknames and inappropriate physical conduct. Roubal also reported discovering illegal business practices within Everflow, such as altering publisher onboarding processes without consent and failing to comply with data privacy laws. Despite reporting these issues to his superiors, including Peter Kurjanowicz and Ed Ceballos, Roubal alleges that no corrective action was taken. Instead, he faced increased hostility from Frieden and was eventually terminated from his position alongside another colleague who had raised similar concerns.
The lawsuit accuses Everflow Technologies Inc. and its representatives of violating several laws under the Fair Employment and Housing Act (FEHA) and the California Labor Code. These include whistleblower retaliation (Cal. Lab. Code § 1102.5), hostile work environment harassment under FEHA, failure to prevent discrimination or retaliation under FEHA, intentional infliction of emotional distress, and wrongful termination in violation of public policy. Roubal asserts that these actions were taken with malice and reckless disregard for his rights as an employee.
Roubal is seeking compensatory damages for lost wages and benefits due to wrongful termination, as well as non-economic damages for emotional distress caused by the hostile work environment. Additionally, he is requesting punitive damages to deter future misconduct by the defendants and attorneys' fees incurred during this legal battle.
