Alabama man alleges Vimo Inc. sent spam texts

SAN FRANCISCO – An Alabama man is bringing a class-action complaint against a California corporation over alleged spam texts.

Todd Goldberg filed a lawsuit Jan. 12 in the U.S. District Court for the Northern District of California against Vimo Inc. of Mountain View, doing business as GetInsured.com, citing violations of the Telephone Consumer Protection Act. 

According to the complaint, Vimo contacted Goldberg via text message on or about Dec. 15 which stated Goldberg “opted in” with the California-based company. Goldberg alleges that he never contacted or conducted any business with the website and that the text message was generated automatically for mass-marketing and distribution purposes.

Goldberg is seeking up to $1,500 in damages for each text made in knowing or willful violation of the TCPA, and $500 for each text made for negligent violations of the TCPA for the class. Todd M. Friedman of the Law Offices of Todd M. Friedman in Beverly Hills is representing Goldberg.
