McKesson Corp. suing over alleged breach of contract

SAN FRANCISCO – A San Francisco corporation is suing two Louisiana corporations and an individual over allegations of unpaid invoices.

McKesson Corp. filed a lawsuit Jan. 7 in the U.S. District Court for the Northern District of California against New Iberia Rx Inc., doing business as Delaune’s Pharmacy and Home Medical; Zachary Rx Inc., doing business as CareRx Express; and Raphael Meche, citing breach of contract, goods sold and delivered, reasonable value, money due, account stated and other counts.

According to the complaint, New Iberia applied for credit with McKesson for the purchase of medical-related products in May 2013. McKesson alleges that New Iberia failed to make the payments, which total $118,005.24. Also in May 2013, the suit states, Zachary applied for credit for the purchase of medical products for $31,462.91. The plaintiff alleges that this has not been paid. Meche executed and delivered guaranties for the other defendants, the suit states.

McKesson is seeking damages against all three defendants for the listed amounts and attorneys' fees. Scott O. Smith and Mancy Pendergrass of Buchalter Nemer of Los Angeles are representing McKesson.
