Surgeon files suit over allegedly being fazed out of a hospital

SAN FRANCISCO — A California medical corporation and one of its surgeons are suing a health care corporation and its entities and are seeking injunctive relief for allegedly being fazed out.

Northern California Minimally Invasive Cardiovascular Surgery Inc., and Ramzi Deeik filed a lawsuit on Dec. 29, 2015, in the Northern District of California District Court San Francisco Division against NorthBay Healthcare Corporation, NorthBay Healthcare Group Inc., and NorthBay Healthcare Medical Group Inc.

According to the claim, Deeik is a double board-certified cardiothoracic surgeon and works at NorthBay, Queen of the Valley Medical Center and Santa Rosa Memorial Hospital. Deeik was excluded from the market by an agreement between two hospitals and multiple competing physicians to force him out of the market of cardiovascular and thoracic surgical services, the suit states. The alleged goal was to push Deeik out of Northbay.

The claims for relief are conspiracy to restrain trade – group boycott, trust/conspiracy to restrain trade, unfair competition and tortious interference with prospective economic advantages. Deeik is seeking damages appropriate to the court’s judgment. Jarod M. Bona and Aaron R. Gott of Bona Law P.C. in La Jolla will represent Deeik.
