Schnitzer Steel seeks to move case to federal court

SAN FRANCISCO – A steel company is seeking a removal to federal court following its alleged breach of contract and wrongful taking of funds.

Schnitzer Steel Industries Inc. filed a request for removal on Dec. 23 in the U.S. District Court for the Northern District of California praying removal from its current court to a federal court.

According to the filing, Howard Misle filed a complaint against Schnitzer Steel on Nov. 19 claiming breach of contract, declaratory relief and conversion. He alleges that the damages he suffered exceed $75,000 by the defendant's purportedly wrongful taking of $86,604.60 in funds from an escrow account.

Schnitzer Steel Industries requests that this civil action be removed from the Superior Court of the State of California, County of San Francisco, to the U.S. District Court for the Northern District of California. It is represented by Thomas A. Woods and Bao M. Vu of Stoel Rives LLP.
