SAN FRANCISCO – Aetna Health and Life Insurance Co. is seeking a removal of a case alleging it denied payment of services.
Aetna filed the request on Dec. 21 in the U.S. District Court for the Northern District of California, seeking removal of the case from the Superior Court of California, County of San Francisco to be removed from that court to the U.S. District Court for the Northern District of California.
According to the case, Jacob Wilen filed a complaint Nov. 23 following his alleged denial of payment of services which he received under his employee welfare benefit plan. The plaintiff sought to discover whether the defendant had violated the Employee Retirement Income Security Act by refusing to honor his claim, the filing states. According to the complaint, Aetna is seeking removal of the case to a federal court, claiming that the claims are under federal law.
