Delta Window Cleaning Company accused of not paying benefits

SAN FRANCISCO — A trust fund and its board of trustees are suing the Delta Window Cleaning Company over the alleged refusal to make required health benefit payments.

The General Employees Trust Fund and the board of trustees of the General Employees Trust Fund filed a lawsuit on Dec. 28, 2015, in the Northern District of California District Court San Francisco Division against the Delta Window Cleaning Company Inc.

According to the suit, Delta was in a collective bargaining agreement with Service Employees International Union, Local 1877 and the United States Service Workers West. Delta agreed that it would pay benefit contributions to the Trust Fund on the 10th day of the calendar month after the previous month when the work was performed, the suit states. According to the suit, there was an audit conducted for the time period between 2012 and 2014 that found that Delta owed the trust fund $35,948.97, including interest.

The plaintiffs are seeking the $37,754.78, plus $5.99 per day in additional interest from Dec. 21, 2015, until the amount is paid. Diane Sidd-Champion of Wylie, McBride, Platten and Renner in San Francisco will represent the plaintiff.
