SAN FRANCISCO – A San Francisco woman claims her late husband's insurance company wrongfully denied her benefits claim.
Leila Dunning filed a complain on Feb. 29 in the U.S. District Court for the Northern District of California against Anthem Blue Cross Life and Health Insurance Co., citing violations of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she filed for benefits under the plan of her late husband, as she is listed as the beneficiary, but was denied multiple times. The plaintiff holds Anthem Blue Cross Life and Health Insurance Co. responsible because the defendant allegedly denied plaintiff's claims despite overwhelming evidence of a covered accidental death and disability loss.
The plaintiff seeks the following: payment of AD&D benefits, interests and any other relief the court deems just and proper. She is represented by Russell G. Petti of The Law Offices of Russell G. Petti in La Canada.
