SAN FRANCISCO – A Connecticut insurance company is seeking a judgment from the court in regards to a lawsuit.

AIX Specialty Insurance Co. filed a complaint on March 1 in the U.S. District Court for the Northern District of California against Ferratex Inc. and Jason Gilmer, seeking declaratory relief.

According to the complaint, Gilmer, who resides in Contra Costa County, filed a lawsuit against Ferratex in November 2015. Ferratex allegedly has a commercial general liability policy through the plaintiff. The plaintiff alleges that its policy does not potentially cover damages, and therefore argues it has no duty to defend Ferratex in the lawsuit.

The plaintiff seeks the following: a declaration that it has no duty to defend the defendant, reimbursement costs, legal fees and any other relief the court deems just and proper. It is represented by John E. Feeley and Colrena K. Johnson of Smith, Smith & Feeley LLP in Newport Beach.
