Boards of trustees sues employer over allegedly unpaid funds

SAN FRANCISCO – Several boards of trustees are suing a San Mateo business over allegations of unpaid contributions.

The board of trustees of the Laborers Health and Welfare Trust Fund for Northern California, board of trustees of the Laborers Vacation-Holiday Trust Fund for Northern California, board of trustees of the Laborers Pension Trust Fund for Northern California, and the board of trustees of the Laborers Training and Retaining Trust Fund for Northern California filed a complaint on March 3 in the U.S. District Court for the Northern District of California against Lynn Lefevre, doing business as Lynn Lefevre's Welding Service, citing breach of collective bargaining agreement.

According to the complaint, the plaintiffs allege that in 2010 and 2011, they suffered damages and will continue to suffer damages due to the defendant's failure to pay monthly contributions to the trust funds. The plaintiffs hold Lynn Lefevre's Welding Service responsible because the defendant allegedly breached its master agreement with the plaintiffs by failing to pay contributions to the trust fund on behalf of its employees.

The plaintiffs seek the following: compensation for all damages in the amount of $120,445.68 plus interest, legal fees and any other relief as the court deems just and proper.
