Investment company sues individuals over allegedly unfair business practices

SAN FRANCISCO – An investment firm is suing several individuals over fraud allegations in regards to operating a winery.

IMC Investment Group FE Winery LLC filed a complaint on March 7 in the U.S. District Court for the Northern District of California against Fairwinds Estate LLC; Criswell Radovan LLC; Robert Radovan, also known as Rob Radovan; William Criswell, also known as Bill Criswell; Lisa Pacey, also known as Lisa Pacey-Willis; and Heather Hill, citing alleged breach of contract, fraud, unfair business practices and other counts.

According to the complaint, the plaintiff alleges that, between 2015 and 2016, it suffered damages to its business and incurred penalty charges that resulted in risking the property to foreclosure. The plaintiff holds the defendants responsible because they allegedly committed fraud and misrepresentation regarding the operation of the winery, which resulted in defaulted loans, penalty interest rates imposed by the lender and damaged credit.

The plaintiff seeks the following: compensation for all damages amounting to $4,000,000 against all defendants, injunctive relief, all legal fees and any other relief as the court deems just and proper. It is represented by Ronald K. Losch and Mark R. Meyer of Losch & Ehrlich in San Francisco.
