Former employee sues Bearden Construction Co. over alleged violation of labor code

SAN FRANCISCO – A construction worker is suing his former employer over claims of unpaid wages.

Enrique German filed a complaint on March 7 in the U.S. District Court for the Northern District of California against Christopher B. Bearden and Bearden Construction Co. Inc., doing business as CB Concrete Construction Inc., citing alleged unfair competition and violations of the Fair Labor Standards Act and California Labor Code.

According to the complaint, the plaintiff alleges that he was employed to work on sidewalk demolition and construction but was not paid for all his hours worked, including overtime and prevailing wages. The plaintiff holds the defendants responsible because they allegedly required plaintiff to work more than 40 hours per work week but failed to properly compensate him.

The plaintiff seeks the following: compensatory damages, interest, all unpaid wages, legal fees and any other relief as the court deems just and proper. He is represented by Tomas E. Margain and Huy Tran of Justice at Work Law Group in San Jose.
