Individual sues Bank of America over alleged racketeeting

OAKLAND – A Contra Costa County homeowner is suing a bank over claims it refused to correct a legal mistake in a loan modification document.

Tommie L. Myles filed a complaint on March 8, in the U.S. District Court for the Northern District of California, Oakland Division against Bank of America Inc., citing the Civil Racketeer Influenced and Corrupt Organizations Act.

According to the complaint, the plaintiff alleges that, on Aug. 15, 2015, he received documents for an approved loan modification on a property he owns with his grandson. He alleges that the documents contained an error that misrepresented the value of the loan upon its transfer. The plaintiff holds Bank of America Inc. responsible because the defendant allegedly did not fix the error, but sold the loan to another party, which denied the plaintiff the modified loan.

The plaintiff seeks an injunction for equitable relief and treble damages. He is representing himself as a private attorney general.
