SAN FRANCISCO – Several trust funds are suing a San Jose employer over allegations of unpaid contributions.

The board of trustees of the Laborers Health and Welfare Trust Fund for Northern California, board of trustees of the Laborers Vacation-Holiday Trust Fund for Northern California, et al. filed a complaint on March 9 in the U.S. District Court for the Northern District of California against Valley Demolition Inc., citing breach of collective bargaining agreement.

According to the complaint, the plaintiffs allege they suffered damages in the amount of $103,139.94, plus interest due to failed payments of the defendant on behalf of its employees from June to November 2015. The plaintiff holds Valley Demolition Inc. responsible because the defendant allegedly failed to pay contributions to the trust funds on behalf of its employees as per the signed master agreement between it and the Northern California District Council of Laborers.

The plaintiffs seek the following: compensation for liquidated damages amounting to $6,145.41, $103,139.94 in unpaid contributions, plus interest, all legal fees and any other relief as the court deems just proper. They are represented by Ronald L. Richman and Susan J. Olson of Bullivant Houser Bailey PC in San Francisco.
