San Francisco carriers sued over alleged damage to cargo

SAN FRANCISCO – Two Canadian companies are suing common carriers based in San Francisco alleging that they damaged a shipment during transport.

Royal & Sun Alliance Insurance Co. of Canada and Canute International Medical Services (Canada) Inc. filed a complaint on March 10 in the U.S. District Court for the Northern District of California against MTI Worldwide Logistics Corp., PROCON Express Lines and Cargo Marketing Services LTD, citing damage to ocean cargo.

According to the complaint, the plaintiffs allege that between Feb. 10, 2015, and Feb. 21, 2015, the defendants received a cargo of medical equipment in the United Kingdom to transport to New Jersey. The plaintiffs holds the defendants responsible because they allegedly failed to deliver plaintiffs' cargo in the same good condition as when they received it.

The plaintiffs seek the following: compensation for all damages in the amount of $6,350, plus interest, all legal fees and any other relief as the court deems just and proper. They are represented by Joshua E. Kirsch of Gibson Robb & Lindh LLP in San Francisco.
