Los Angeles man sues over alleged use of defeat devices in cars

SAN FRANCISCO – A Los Angeles man is suing a car manufacturer alleging that it knowingly violated U.S. environmental law by putting a "defeat device" in its diesel-powered cars that would temporarily reduce emissions in order to pass inspection.

Anthony Amersfoort filed a complaint on March 10 in the U.S. District Court for the Northern District of California against Volkswagen Aktiengesellschaft and Volkswagen Group of America, citing fraud, breach of contract and other counts.

According to the complaint, the plaintiff alleges that he purchased a new vehicle in 2013 equipped with an emissions control defeat device. The plaintiff holds Volkswagen Aktiengesellschaft and Volkswagen Group of America responsible because the defendants allegedly manufactured automobiles with the device despite of the environmental laws in place.

The plaintiff seeks the following: compensation for all damages determined in trial, monetary, injunctive and equitable relief related to the defeat device. He is represented by Stephen G. Recordon of Recordon & Recordon in San Diego.
