Personal care product makers sue over alleged fraudulent competition

Judges bench

FRESNO – The makers of personal care products are suing a competitor, alleging that they made false claims about their product.

Glenn A. Abrahamson, Joseph Wong and BB17 LLC filed a complaint on March 11 in the U.S. District Court Eastern District of California Fresno Division against Brad Berkley, citing alleged breach of fiduciary duty, unfair and fraudulent competition, tortious interference with prospective business relations, malicious prosecution and civil conspiracy.

According to the complaint, the plaintiffs allege that they suffered damages to their business, loss of property and emotional damages due to false claims made about their personal care products. The plaintiff holds Brad Berkley responsible because the defendant allegedly made false statements to retail distributors that plaintiff's products were unfit for human use.

The plaintiffs seek compensation for all damages, compensation for all gains, profits and advantages derived from the unlawful act, all legal fees and any other relief as the court deems just and proper. They are represented by Richard C. Conway of Kahn, Soares & Conway LLP in Hanford.
