Woman alleges Liberty Life Assurance Co. of Boston wrongfully terminated benefits

SACRAMENTO – A Sacramento County woman alleges that her disability benefits were wrongfully terminated.

Gail Shamberg filed a complaint on March 14 in the U.S. District Court for the Eastern District of California against Liberty Life Assurance Co. of Boston, an insurance company, citing breach of contract and fraud.

According to the complaint, the plaintiff alleges that she began receiving disability benefits in April 2014 but these benefits were later terminated in January 2015 by the defendant. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly determined plaintiff's capacity to work by employing a nonexamining doctor to access plaintiff's respiratory issues. The suit states she filed appeals with no avail.

The plaintiff seeks the following: compensation for all damages, all legal fees and any other relief as the court deems just and proper. She is represented by Jesse S. Kaplan in Carmichael.
