Fingerhut alleged to have violated TCPA

SAN FRANCISCO – A Pleasant Hill woman alleges that Minnesota-based business called her four and five times a day using an automatic telephone dialing system to contact an unknown third party.

Patti Alvarez filed a complaint on March 15 in the U.S. District Court for the Northern District of California against Bluestem Brands Inc., doing business as Fingerhut, citing violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she received calls on her mobile telephone using a pre-recorded voice from the defendant beginning in September 2014. The suit states the defendant was attempting to contact an unknown person named Gilmar Breiter, and that she has spoken to the defendant's representatives to inform them they had the wrong number. The plaintiff holds Fingerhut responsible because the defendant allegedly used an automatic telephone dialing system in contacting plaintiff, which is a violation of the TCPA.

The plaintiff seeks the following: compensation for all damages, injunctive relief and any other relief as the court deems just and proper. She is represented by Amy Lynn Bennecoff Ginsburg of Kimmel & Silverman PC in Ambler, Pennsylvania.
