Companies allege Frontier Renewables LLC broke contract

Solar

SAN FRANCISCO – A San Mateo company is being accused of breaching a contract relating to a solar project.

GEC US 1 LLC, AS (Wright) LLC and Activ Solar Holdings (US) Inc. filed a complaint on March 15 in the U.S. District Court for the Northern District of California, San Francisco Division against Frontier Renewables LLC, citing breach of contract.

According to the complaint, the plaintiffs allege that they entered into an agreement to support four solar photovoltaic power generation projections with the defendant and despite fulfilling all contractual obligations, the plaintiffs claim they are being denied access to books and records. The plaintiffs hold Frontier Renewables LLC responsible because the defendant is allegedly attempting to market the project without the plaintiffs' input, which is in violation of the agreement.

The plaintiffs seek the following: compensation for all damages, injunctive relief enjoining the defendant from continuing to violate the agreement of both parties, all legal fees and any other relief as the court deems just and proper. They are represented by Meryl Macklin of Bryan Cave LLP in San Francisco and Matthew J. Smith and Chuan "CiCi" Cheng of Holland & Hart LLP in Denver, Colorado.
