SAN FRANCISCO – Two employees allege that their unions did not protect them from discriminatory treatment in the workplace.

Sheila E. Jay and Robin Bongon filed a complaint on March 18 in the U.S. District Court for the Northern District of California against Service Employees International Union - United Healthcare Workers West, also known as Service Employees International Union - Local 250; International Union of Operating Engineers - Stationary Engineers Local 39; and Does 1 through 30, citing breach of duty of fair representation, breach of the implied covenant of good faith and fair dealing and unfair business practices.

According to the complaint, the plaintiffs allege that they were employed by Kaiser Foundation Hospitals and were members of the defendants' unions. When the plaintiffs went to their unions for help with labor issues, they allege that the unions did not protect or defend them. They allege the unions were neglectful and discriminatory in their treatment of them. Jay alleges she was wrongfully terminated from her job and Bongon alleges she was retaliated against.

The plaintiffs seek the following: compensation for all damages, plus interest, all legal fees and any other relief as the court deems just and proper. They are represented by Marylon M. Boyd of Law Offices of Marylon M. Boyd in Oakland.
