Via Licensing Corp. alleges damages due to contract breach

SAN FRANCISCO – A patent pool administrator alleges it suffered damages after two companies it contracted with wrongfully breached their contract by failing to provide quarterly reports as well as failing to pay royalty payments.

Via Licensing Corp. filed a complaint on March 22 in the U.S. District Court for the Northern District of California against Compal Electronics Inc. and Auscom Engineering Inc., citing breach of contract.

According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its contractual agreement with the defendants being breached. The plaintiff holds Compal Electronics Inc. and Auscom Engineering Inc. responsible because the defendants allegedly breached their contractual agreement with plaintiff multiple times when they failed to provide quarterly reports, records and disclose the total units sold. The defendants also failed to pay the royalty fees associated with those sales, the suit states.

The plaintiff seeks the following: compensation for all damages, an order to provide performance quarterly report, all legal fees, interest and any other relief as this court deems just and proper.
