Clovis woman alleges voicemail from company violated debt collection practice laws

SACRAMENTO – A Clovis woman is suing a collections agency over allegations it violated debt collection practices laws.

Nicole Lyon filed a complaint on March 24 in the U.S. District Court for the Eastern District of California against Bergstrom Law LTD, citing violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges in February she was contacted by the defendant on her mobile phone regarding a student loan debt. The plaintiff holds Bergstrom Law responsible because the defendant allegedly contacted the plaintiff and left a voicemail message on her mobile phone, but failed to disclose that it was calling on behalf of a collections agency, which is in violation of the FDCPA.

The plaintiff seeks the following: a trial by jury, all damages, all legal fees and any other relief as this court deems just. She is represented by Crosby S. Connolly and Joshua B. Swigart of Hyde & Swigart in San Diego.
