EUREKA – An Irvine man is suing a food manufacturer over allegations it falsely labels the amount of tuna in its cans.
Heney Shihad filed a class-action lawsuit on March 25 in the U.S. District Court for the Northern District of California, Eureka Division against Wild Planet Foods Inc. and Does 1 through 25, citing alleged breach of implied warranty, breach of warranty, fraud and negligent misrepresentation.
According to the complaint, the plaintiff alleges that he was misinformed into buying a branded tuna that says it contains 5 ounces but it does not. The plaintiff holds Wild Planet Foods Inc. and Does 1 through 25 responsible because the defendant allegedly labeled that its product has 5 ounces of tuna inside of the can but upon inspection it was revealed that it was under-filled.
The plaintiff seeks the following: compensation for trial by jury, all damages, prejudgment interest, monetary and injunctive relief, all legal fees and any other relief as this court deems just. He is represented by Reuben D. Nathan and Ross Cornell of Nathan & Associates, APC in Newport Beach.
