SAN FRANCISCO – A Santa Clara County man alleges that a prescription drug caused skin cancer.
Joao Delgado filed a complaint on March 24 in the U.S. District Court for the Northern District of California against Pfizer Inc., a pharmaceutical company, citing breach of implied warranty, breach of express warranty, fraud, negligence, unjust enrichment and other counts.
According to the complaint, the plaintiff alleges that he was diagnosed with melanoma in 2006 as a result of consuming Viagra. The plaintiff holds Pfizer Inc. responsible because the defendant allegedly failed to properly test its product before distributing it and also failed to warn consumers of the hazards of using such products.
The plaintiff seeks the following: a trial by jury, all damages, all legal fees and any other relief as this court deems just and proper.
