Bos Sheet Metal Inc. accused of violating bargaining agreement

SAN FRANCISCO – Several boards of trustees of labor unions are suing a sheet metal company alleging that it failed to pay contributions in accordance to their bargaining agreement.

Boards of trustees of the Sheet Metal Workers' Pension Plan of Northern California; and Rick Werner, as trustee; Sheet Metal Workers' Local Union No. 104 District 2 Vacation Plan; Northern California Sheet Metal Workers' Health Care Plan; et al., filed a complaint on April 11 in the U.S. District Court for the Northern District of California against Bos Sheet Metal Inc., citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that between January and February they suffered monetary damages as a result of unpaid contributions from the defendant. The plaintiffs hold Bos Sheet Metal Inc. responsible because the defendant allegedly failed to pay contributions on behalf of its employees.

The plaintiffs seek unpaid contributions, liquidated damages on all late paid and unpaid contributions plus interest, all legal fees and any other relief as the court deems just. They are represented by Michele R. Stafford and Timothy A. Froehle of Saltzman & Johnson Law Corp. in San Francisco.
