SAN FRANCISCO – A German automobile manufacturer has filed suit against a Hayward business alleging it sells counterfeit Mercedes-Benz wheels.
Daimler AG filed a complaint on April 11 in the U.S. District Court for the Northern District of California against A Spec Wheels & Tires LLC, Jun Huang and Does 1-10, citing trademark infringement, design patent infringement, unfair competition, false advertising and other counts.
According to the complaint, the plaintiff alleges that it suffered damages to its business as a result of its products being copied and sold. The plaintiff holds the defendants responsible because the defendants allegedly advertised and sold through their website copies of plaintiff's automotive wheels and marks, which may bring confusion to plaintiff's customers.
The plaintiff requests a trial by jury and seeks permanent injunction enjoining defendants from further infringing plaintiff's patents, damages adequate to compensate plaintiff in an amount to be proven in trial plus interest at the maximum rate permitted by law, treble damages plus interest, order for the defendant to destroy all infringing products and advertising materials, monetary damages to be proven in trial, statutory damages of $2 million per counterfeit mark per type of goods or services sold, all legal fees and any other relief as this court deems just.
