Greg Van Dyke, President of California Consumer Advocates for Affordability and Safety, emphasized the importance of ending frivolous lawsuits to reduce costs for consumers, promote business growth, and enhance affordability in California. This statement was made in a blog post.
"Unfettered lawsuit abuse is causing higher prices for everyday goods and services — from the groceries we buy at the store to the care we receive at the doctor's office," said Van Dyke. "It's past time for California lawmakers to get serious about tort reform and stop frivolous lawsuits. Ending lawsuit abuse is essential for creating an environment where businesses and consumers alike can thrive. Let's work together to implement common-sense reforms that will benefit every Californian."
According to AudioEye, as of 2025, the number of digital accessibility lawsuits under the Americans with Disabilities Act (ADA) continues to rise, with California being one of the most active states for such filings. Businesses of all sizes are increasingly targeted by these lawsuits, often facing costly settlements regardless of intent or harm. Experts suggest that greater clarity and reform are necessary to mitigate predatory legal actions.
A study conducted in 2024 by the U.S. Chamber of Commerce Institute for Legal Reform found that total tort costs in the United States reached $443 billion in 2020, representing about 2.1% of GDP. California was noted for having some of the highest per-household tort costs nationally, significantly contributing to the overall burden. High tort costs are identified as a major factor in increasing living and business expenses.
Seyfarth reported that in 2024 plaintiffs filed 8,800 federal lawsuits under Title III of the ADA, reflecting a rebound after a slight decline in 2023. California remained a leading state for these filings, highlighting ongoing concerns about ADA-related lawsuit abuse. Experts note that these lawsuits increasingly target businesses over website and mobile app accessibility.
