Nurse alleges Metropolitan Life wrongfully terminated benefits

SAN FRANCISCO – A former surgical registered nurse alleges her disability benefits were wrongfully terminated.

Melissa Changeux filed a complaint on April 7 in the U.S. District Court for the Northern District of California against Metropolitan Life Insurance Co. and Sutter Health, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled on June 7, 2011, and was paid long-term disability benefits through Oct. 7, 2014. She alleges benefits were terminated after that date. The plaintiff holds Metropolitan Life Insurance Co. and Sutter Health responsible because the defendant allegedly claims that the results of plaintiff's tests by her physicians were inadequate to be granted the benefits. The defendant allegedly also ignored the findings of the U.S. Social Security Administration that plaintiff is totally disabled.

The plaintiff requests a trial by jury and seeks payment for plan benefits and interest plaintiff is entitled to from Oct. 8, 2014, until present, all damages, all legal fees and any other relief as this court deems just.
