Woman files suit over alleged denial of late husband's insurance coverage

SACRAMENTO – A widow an insurance company over claims part of her late husband's insurance coverage was denied to her.

Maria Hobbs filed a complaint on April 19 in the U.S. District Court for the Eastern District of California against Metropolitan Life Insurance Co., VF Corp., VF Corp. Health and Welfare Plan, citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on Dec. 15, 2014, her husband passed away and she was paid basic life and supplemental life coverage but her claim for accidental death and dismemberment coverage was denied. The plaintiff holds the defendants responsible because the defendants failed to provide and prompt and reasonable explanation for the denial.

The plaintiff seeks payment of insurance proceeds in the amount of $300,000, enforcement of her rights under the terms of the plan, interest, all legal fees and any other relief as the court deems just. She is represented by Glenn R. Kantor, Alan E. Kassan and Mitchell O. Hefter of Kantor & Kantor LLP in Northridge.
