Federal agency alleges Bitmicro Networks violated labor laws

SAN FRANCISCO – The U.S. Secretary of Labor for the Department of Labor has filed a suit against a Fremont company over allegations it did not pay its employees overtime.

Thomas E. Perez filed a complaint on April 20 in the U.S. District Court for the Northern District of California against Bitmicro Networks Inc. alleging violation the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between July 21, 2012, and July 20, 2015, the defendant paid its employees less than federal minimum wage. The plaintiff holds Bitmicro Networks Inc. responsible because the defendant allegedly failed to pay overtime wages to its employees that work more than 40 hours per work week at a rate of time-and-one-half.

The plaintiff seeks to permanently enjoin the defendant from violating the provisions of FLSA, liquidated damages equal to the amount of minimum and overtime wages found due to the defendant's employees, interest, all legal fees and any other relief as the court deems just. He is represented by Janet M. Herold, Susan Seletsky and Andrew J. Schultz of U.S. Department of Labor in San Francisco.
