S&J Rentals alleges purchased tool was defective

SACRAMENTO – A Yuba City company alleges that a Plano, Texas company manufactures defective products.

S & J Rentals, doing business as Twin Cities Equipment Rentals, filed a complaint on April 27 in the U.S. District Court for the Eastern District of California against Hilti Inc. citing alleged breach of implied warranty.

According to the complaint, the plaintiff alleges that on July 20, 2012, it purchased two tools used for chiseling concrete and related items and claim in 2015 the tools shut down and can no longer be used. The plaintiff holds Hilti Inc. responsible because the defendant allegedly denied and covered up knowledge of the defect.

The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages, all legal fees and any other relief as this court deems just. It is represented by William Kershaw, Stuart C. Talley and Ian J. Barlow of Kershaw, Cook & Talley PC in Sacramento.
