Nurse alleges United of Omaha wrongfully terminated disability benefits

SAN FRANCISCO – A former Mendocino Coast District Hospital nurse alleges her insurance company wrongfully terminated her long-term disability benefits.

Helen Thacker filed a complaint on April 28 in the U.S. District Court for the Northern District of California against United of Omaha Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that beginning on April 10, 2013, she became disabled and applied for long-term disability plan benefits, which were initially approved by the defendant. The plaintiff holds United of Omaha Life Insurance Co. responsible because the defendant allegedly denied plaintiff's claim for plan benefits, claiming that plaintiff does not meet the definition under the terms of the plan in May 2015.

The plaintiff seeks pay plaintiff all benefits plus interest, declaration that she is entitled to receive future plan benefits, equitable surcharge payable to plaintiff, interest, all legal fees and any other relief as this court deems just. She is represented by Scott Kalkin of Roboostoff & Kalkin in San Francisco.
