SAN FRANCISCO – Several employee trust funds have filed a suit against an employer alleging it did not pay contributions for two months this year.
Boards of trustees of the Sheet Metal Workers Local 104 Health Care Trust, Sheet Metal Workers Pension Trust of Northern California, Sheet Metal Workers Local 104 Supplemental Pension Fund, et al., filed a complaint on April 28 in the U.S. District Court for the Northern District of California against California Air Inc. alleging that the employer failed to uphold their bargaining agreement.
According to the complaint, the plaintiffs allege that in February and March, they were damaged as a result of unpaid contributions by the defendant. The plaintiffs hold California Air Inc. responsible because the defendant allegedly failed to pay monthly contributions to the trust funds on behalf of its employees.
The plaintiffs seek an order for the defendant to comply with its obligations to the trust funds, any unpaid contributions, liquidated damages on all late paid and unpaid contributions plus interest, all legal fees and any other relief as the court deems just.
