SACRAMENTO – A former secretary/clinic receptionist has filed a suit against her insurance company for long-term disability benefits.
Sarah Moncada filed a complaint on April 29 in the U.S. District Court for the Eastern District of California against Life Insurance Co. of North America and Does 1 to 100 citing violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that she is disabled due to chronic pain. She alleges on Jan. 21 she applied for long-term disability benefits but was denied by the defendant. The plaintiff holds Life Insurance Co. of North America and Does 1 to 100 responsible because the defendants allegedly denied plaintiff's application for plan benefits despite being approved for Social Security benefits and providing all medical documents to support her claim.
The plaintiff seeks damages for failure to provide full benefits of the plan including interest, all legal fees and any other relief as this court deems just. She is represented by David Allen of David Allen & Associates in Sacramento.
