24 Hour Fitness faces class-action suit over lifetime membership fees

SAN FRANCISCO – An Orange County man has filed a class-action lawsuit against a gym over allegations it raised rates for certain members despite claims it would not do so.

Russell Marchewka filed a complaint on behalf of all others similarly situated on April 29 in the U.S. District Court for the Northern District of California against 24 Hour Fitness USA Inc. citing unfair business practices and violation of the Consumer Legal Remedies Act.

According to the complaint, the plaintiff alleges that in 2007 he purchased a lifetime membership to the defendant's gym with the promise that he would only need to pay $69 per year after January 2010 for the membership. The plaintiff holds 24 Hour Fitness USA Inc. responsible because the defendant allegedly raised the membership fee to $119 in 2015.

The plaintiff requests a trial by jury and seeks actual damages, restitution, injunctive relief that orders the defendant not to raise the renewal rates, interest, all legal fees and any other relief as this court deems just.
